I hereby apply on behalf of the Applicant for a Credit Account to be opened with SELPAK Automation New Zealand Limited and, in consideration of the supplier agreeing to open such a Credit Account, and to the full extent permitted by law:

1. I warrant that I am a principal/director/trustee of the Applicant described in the section "Applicant @/or Parent Company Details" of this application and am authorized to make this Application on the Applicant’s behalf and to execute on behalf of the applicant the acknowledgements, consent and indemnity set forth in paragraph 4,5 and 6.

2. I hereby personally guarantee the payment of all monies payable from time to time by the Applicant to SELPAK Automation New Zealand Limited and also due and full compliance by the Applicant with SELPAK Automation New Zealand Limited Trading Terms, which I have read, understood and accepted. I further indemnify and agree to keep indemnified SELPAK Automation New Zealand Limited in respect of any loss or expense incurred by SELPAK Automation New Zealand Limited as a consequence of any failure by the applicant to comply with SELPAK Automation New Zealand Limited Trading Terms. This guarantee and indemnity shall continue regardless of any extension of time or other indulgence that may be granted by SELPAK Automation New Zealand Limited to the Applicant from time to time.

3. I warrant that the information provided on page 1 of this Application is true and correct.

4. I acknowledge that SELPAK Automation New Zealand Limited has furnished the Applicant with a complete copy of this Application and has advised the Applicant:

   1. Of the identities of SELPAK Automation New Zealand Limited and how to contact them; and

   2. That SELPAK Automation New Zealand Limited is able to gain access to the information supplied in this Application form; and

   3. That if there is any default by the Applicant in making payment to SELPAK Automation New Zealand Limited, the information collected in this Agreement, together with the information as to the amounts claimed by SELPAK Automation New Zealand Limited be owing from time to time by the Applicant to SELPAK Automation New Zealand Limited and legal or other steps taken by SELPAK Automation New Zealand Limited to recover such amounts, (all of which information and any related information is called “the default information”) may be furnished by SELPAK Automation New Zealand Limited it’s members and their employees from time to time; and

   4. That the supply of goods to the Applicant may be refused if any particulars requested by SELPAK Automation P New Zealand Limited are not provided by the Applicant or if these terms are not agreed to by the Applicant.

5. The Applicant acknowledges that SELPAK Automation New Zealand Limited has requested the Applicant to let SELPAK Automation New Zealand Limited know immediately in writing if at any time the Applicant believes that the default information collected, used or disclosed by SELPAK Automation New Zealand Limited is not accurate, complete and up to date. The Applicant acknowledges having been advised by SELPAK Automation New Zealand Limited that the Applicant is entitled to access the default information from time to time and require SELPAK Automation New Zealand Limited to take all reasonable steps to ensure that all such information is accurate, complete and up to date.

6. The Applicant and I each indemnify and will keep indemnified SELPAK Automation New Zealand Limited against all actions, demands, liabilities, proceedings, judgements, or orders, claims, costs and expenses which SELPAK Automation New Zealand Limited may suffer, incur or sustain (including any liability which SELPAK Automation New Zealand Limited may incur to the Applicant) in connection with or arising in any way whatsoever as a consequence of:

   1. The collection use or disclosure of the default information as referred to in the act; and

   2. Any such information not being accurate, complete and up to date.

   3. Any misuse and loss of information;

   4. Any unauthorized access to, modification or disclosure of any such information;

   5. The failure to provide the Applicant or anyone on its behalf with access to such information and the opportunity to correct any errors; and

   6. The identification of any natural person is such information; and

   7. Any interference with privacy within the meaning of the Privacy Act by SELPAK Automation New Zealand Limited; and

   8. Any breach by the said Act by SELPAK Automation New Zealand Limited; and

   9. Any breach by SELPAK Automation New Zealand Limited of the National Privacy Principles defined by the 12 principals of the act.
      

PLEASE NOTE THAT OUR CREDIT TERMS ARE STRICTLY 30 DAYS

1. All invoices are due 30 days from end of month.

2. Any claims arising from invoices must be made within ten (10) working days of receipt of invoice

By submitting this application, you authorise Selpak Automation Pty Ltd to make inquiries into the banking and business/trade references that you have supplied.
